El homicidio simple o mejor entendida como la muerte provocada a un ser humano por otro semejante, generalmente de manera violenta. A lo largo de la historia de la humanidad este delito es muy recurrente y se han presentado sin excepción desde el inicio de la humanidad, tal es el caso del fratricidio de Caín y Abel que está rememorado en la Biblia, asimismo podemos decir que las grandes civilizaciones de la antigüedad no han sido ajenas a este delito, como Mesopotamia, Egipto, Grecia y entre ellas podemos recalcar a la famada Roma, el homicidio en sus inicios era conocido con la voces latinas como el parricidum y el perduellio, sin embargo por diversos motivos se la denomino como el homicidium siendo este el termino u origen más conocido del homicidio.
Cabe recalcar que en la antigüedad existían diversas leyes que regulaban el delito de homicidio, entre ellas tenemos el Código de Hammurabi, las Doce Tablas del Derecho Romano Roma, la Ley Cornelia, la ley Pompeya entre otras que sancionaban este delito con penalidades severas. Asimismo, en la antigua Roma podemos ver la existencia de una clasificación de delitos que eran relativos o considerados homicidio. Y es así con el pasar de los años este delito ha ido incrementado y lo podemos encontrar presente en nuestra legislación peruana.

El delito de estafa yace desde los tiempos del Imperio Romano, esta, en un primer momento se conoce como stellionatus y dolo malo, los cuales eran consideradas como crimen de alta traición, en este delito es muy recurrente el uso del engaño para cometer fechorías, el cual se estima como medio no violento para conseguir que el bien les sea entregado voluntariamente, perteneciente a otro o un tercero. Asimismo, dentro del delito de estafa se configuran diferentes supuestos en los que el engaño de forma creativa y falsa, juega un papel importante en la comisión de este delito de estafa. Amén, el delito de estafa junto a otros delitos que tenían como medio el engaño para cometer lo ilícito, se consideraban como similares al momento de la punición. Este delito es castigado por diferentes textos antiguos que yacía en dicha época.
El delito de estafa, es definido como la lesión que se comete contra el patrimonio, y sus elementos tradicionales y principales son: el engaño, error, disposición patrimonial y perjuicio. En la presente investigación se estudia la estafa en la legislación Romana (se examinan los puntos más relevantes en el estudio del delito de estafa). Y también en la legislación Peruana, se explica su bien jurídico protegido y los ya dichos elementos del tipo. Por último, se realiza un análisis comparativo entre estas dos legislaciones (Roma-Perú) en el delito de estafa.

Se debe tomar como punto de partida el Derecho Romano para conocer los inicios y el desarrollo de la “Legítima Defensa”. Por lo tanto, al hablar de legítima defensa, debemos centrar la investigación en los factores históricos y en las condiciones políticas, sociales, económicas y religiosas que fueron claves para dar inicio a la creación de la figura jurídica de la legítima defensa.

En el presente trabajo de investigación se da conocer de qué manera se regulaban en el derecho romano, el titular de acción. La investigación de un hecho ilícito en la antigua Roma, se dio desde su fundación y en las diversas épocas en las que tuvo, en las que se desarrolló diversos castigos para sancionar aquellos ilícitos penales, procesos e instituciones quienes estuvieron un doble deber en el de juzgar y el de administrar la justicia, en comparación con la legislación peruana, quien asumen este deber única y exclusivamente es el Ministerio Publico sus antecedentes con unanimidad en doctrina se debe al antiguo derecho francés, es debido a ello, que esta figura es una cuestión actual, en tal sentido, no se puede desprender con claridad que dicha institución también se haya desarrollo en el antiguo derecho romano.

En el presente trabajo de investigación se da conocer de qué manera se regulaban en el derecho romano, el titular de acción. La presente monografía pretende realizar una investigación de los principios de dirección e impulso procesal en la regulación peruana y la manera en que estos se desarrollaron en el derecho procesal civil romano. De esta forma, el trabajo se desarrolla tomando en cuenta los tres procedimientos civiles existentes en Roma, realizándose comparaciones entre ellos y su particular modo de desarrollar estos principios. Se hace especial énfasis en el tercer procedimiento civil romano, denominado procedimiento extraordinario, ya que este es el que mayor similitud presenta con nuestra legislación actual. Debido a que nuestro derecho actual, tiene sus inicios en el derecho romano, es necesario conocer como se dieron estos principios en Roma.
